Applying for Asylum

Every year people come to the United States seeking protection because they have suffered persecution or fear that they will suffer persecution due to:

Race

Religion

Nationality

Political Opinion

Membership in a particular social group

Your application must be submitted within the first year of arrival to the United States.

Fees

There is no fee to apply for asylum

Family

You may include your spouse and children (beneficiaries) who are residing in the US. Your child must be under 21 and unmarried. Each family member must apply separately.

Required Material

6 passport photos for the applicant
4 passport photos for each beneficiary
Birth certificate copy and translation
Marriage certificate
Valid photo identification
Personal Statement

Permission to Work in the United States (EAD)

150 days after you file your completed asylum application (excluding delays), you may apply for employment authorization (EAD card or Red card). 30 days after submitting the I-765, an applicant will receive a biometrics appointment notice. Approximately 90 days following the biometrics appointment, an applicant will receive an EAD approval notice and work permit.

** The first filing fee for the I-765 application is waived for asylum applicants. Filing fees are required for renewal.

Applying for Legal Permanent Residence (Green Card)

One year after being granted asylum, you may apply for a green card. You must submit a separate I-485 application packet for yourself and, if applicable, for each family member who received derivative asylum based on your case.

** The filing fee for the I-485 is waived for asylum applicants.
