Special Occupation

H1B1 is an employment-based visa for workers who are in specialty occupations, foreign national applicants must have an employer willing to petition them.

  • Foreign national must have a Bachelors degree, related to a specialized occupation.
  • The employer must offer the foreign national a specialized occupation, this can be difficult to explain and requires an experienced attorney to file the applications.
  • The H1B1 are numerically capped for private industry employers.
  • Opening dates for applications to the USCIS is April 1st of each year for a start date of October 1st of the same year.
  • USCIS uses a lottery system to select a total of 85,000 H1B1 applications for processing.
  • In the past several years there have been more than 200,000 applications submitted.
  • If the foreign national works at a university of another qualifying employer which is not subject to the cap the H1B1 may be submitted at any time during the year.

L1A Intracompany Transferee

L1 and L1A inter-transferee visas allow foreign company employees to transfer into the US, accept wages, and remain in the United States.

  • There should be an affiliate subsidiary partner company in the foreign country.
  • The new office should be a subsidiary affiliate partner of the home company.
  • The foreign national must have been employed by the home company for at least one year in the two years prior to filing.
  • These applications are very difficult, thus an attorney is necessary for a successful
    filing.

L1B Intracompany Transferee

L1B inter-transferee visa allows foreign nationals with specialized knowledge to move from home office in another country to a local branch or subsidiary or affiliate in the United States.

  • L1B applicant must have been employed with the company at least one year in the two years prior to filing.
  • These applications are complicated and require an attorney ro file.

Extraordinary Ability

O1 extraordinary ability non-immigrant visa petition allows individuals who have achieved prominent levels of success in their field to obtain a non-immigrant status through an employer petitioner.

Applicant should meet at least three of the criteria listed below:

  • Applicant must provide receipt of a degree/ diploma/ certificate/ similar award.
  • Applicant must provide letters documenting at least 10 years of full-time experience in their field or occupation.
  • Applicant must provide salary or other numeration for services that demonstrate your exceptional ability.
  • Applicant must provide any recognition for their achievements and significant contributions to their industry by: peers, government, and/or professional or business organization.
  • Applicant must provide a license to practice their profession or certification for their profession or occupation.
  • Applicant must provide membership to a professional association

Religious Worker

R1 Religious Worker visa allows for a foreign national to enter the United State to temporarily perform religious duties.

Applicant must be petitioned by a 501(c)(3) employers such as:

  • A non-profit religious organization in the United States;
  • A religious organization that is authorized by a group tax exemption holder to use its group tax exemption; or
  • A non-profit religious organization which is affiliated with a religious denomination in the United States.

TN NAFTA

The North America Free Trade Agreement (NAFTA) visa is based on a treaty relationship between the United States, Canada, and Mexico. The TN visas allow for professionals employed by a United States employer to work temporarily in the United States in professional capacities.

You may be eligible for TN nonimmigrant status, if:

  • You are a citizen of Canada or Mexico;
  • Your profession qualifies under the regulations;
  • The position in the United States requires a NAFTA professional;
  • You have a prearranged full time or part-time job with a U.S. employer (but not self-employment)
  • You have the qualifications to practice in the profession in question.
