Extraordinary Ability

A visa for individuals with extraordinary ability and acclaim who are seeking to come to the United States to continue their work.

 

In order to qualify for the EB-1A visa, you must demonstrate extraordinary ability in the sciences, arts, education, business, or athletics and attained national or international acclaim. You must also demonstrate that you will continue to work in your field in the United States and that your work will substantially benefit the United States. It is not required to have an offer of employment or labor certification for this visa.

 
 

Advanced Degree or Exceptional Ability

A visa for individuals with an advanced degree or exceptional ability and have achieved acclaim seeking to come to the United States to continue their work. This visa also includes the option of the EB-2 NIW application, which waives certain requirements for the visa.

The EB-2 visa can be attained from either the Advanced Degree category or the Exceptional Ability category. Unlike the EB-1 visas, labor certification will be required unless it is waived with the National Interest Waiver (“NIW”). However, it is easier to satisfy the requirements of the EB-2 NIW application than the EB-1 visa.

 

Outstanding Professor or Researcher

A visa for individuals who are outstanding professors and researchers and have achieved acclaim seeking to come to the United States to continue their work.

In order to qualify for the EB-1B visa, you must demonstrate that you have gained international recognition for your outstanding achievements in a particular field, that you have at least 3 years of experience in teaching or research in your field, and you have a tenure track teaching or research position at an institution of higher education. If your employer is a private company, they must employ at least 3 persons full time in research activities and have achieved documented accomplishments in an academic field.
